Event Rentals eyes exclusivity extension to close sale, receive claims

By Caroline Salls

Pittsburgh, May 19 - Event Rentals, Inc. requested an extension of its exclusive periods for filing and soliciting votes on a liquidating plan, according to a Monday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive filing period to Oct. 13 from June 13 and the solicitation period to Dec. 13, 2014 from Aug. 13.

According to the motion, the sale of Event Rentals' assets has not closed, so the size of its estates is not set.

"It would be improvident for the debtors to draft a plan before the sale has closed and the size of the estates and the amounts to be distributed to creditors is certain," the motion said.

The company said it intends to file a plan soon after the sale closes, but it may not be possible to have a fully negotiated plan in place before the current exclusive filing period expires.

In addition, Event Rentals said its general claims filing deadline expires shortly before the current exclusive filing period expires, and the governmental claims filing deadline expires after the exclusive period.

"The universe of claims eligible to receive distributions from and vote on the plan will not be determined before the exclusive filing period expires," the company said.

A hearing is scheduled for June 19.

Event Rentals, an Inglewood, Calif.-based provider of event rental products and related services, filed bankruptcy on Feb. 13. The Chapter 11 case number is 14-10282.
