Energy Future plan hearings scheduled to begin on Aug. 17 and Sept. 26

Pittsburgh, May 24 – Energy Future Holdings Corp.’s Texas Competitive Electric Holdings Co. LLC (TCEH) debtors’ plan confirmation hearing is scheduled to begin on Aug. 17, and the hearing on confirmation of the “E-side” debtors will begin on Sept. 26, according to an order filed Tuesday with the U.S. Bankruptcy Court for the District of Delaware.

As previously reported, Energy Future filed a new plan of reorganization and related disclosure statement earlier this month after its previous plan support agreement, merger and purchase agreement and backstop agreement were terminated.

The court said in Tuesday’s scheduling order that separate confirmation hearings would allow the TCEH debtors and their supporting first-lien creditors to prosecute the new plan for those debtors “if any of the E-side debtors are unable to prosecute, confirm or consummate the plan as it relates to such E-side debtors.”

The TCEH debtors’ disclosure statement hearing will begin on June 16, and the E-side debtors disclosure statement hearing will start on July 21.

Energy Future, a Dallas-based power generation company and utility operator, filed for bankruptcy April 29, 2014. The Chapter 11 case number is 14-10979.
