Eclipse Aviation customers request official committee representation

Pittsburgh, Dec. 3 - Three Eclipse Aviation Corp. customers asked the U.S. Bankruptcy Court for the District of Delaware to appoint an official customers committee for the company's bankruptcy case, according to a Wednesday court filing.

According to the motion, Eclipse's current order book, its most vital asset, represents the commitment of hundreds of customers who have paid more than $300 million in outstanding deposits, waited for years for delivery of their aircraft and "stood beside the debtors during production delays, price increases and other roadblocks."

"Collectively, these individuals will have a significant impact on the debtors' value," the customers said in the motion.

Despite their significant financial stake, customers David Green, Michael Murdock and Shari Meyer said Eclipse's customers have been completely excluded from the company's asset sale process.

"While purchasers will be interested in the debtors' customer base, the hundreds of customers who are the foundation of the debtors' business have been denied any role in the sale process," the customers said in the motion.

Eclipse, an Albuquerque-based aircraft manufacturer, filed for bankruptcy on Nov. 25. Its Chapter 11 case number is 08-13031.
