Former Eddie Bauer seeks exclusivity extension to move plan forward

By Caroline Salls

Pittsburgh, Jan. 13 - EBHI Holdings, Inc., formerly Eddie Bauer Holdings, Inc., has requested an extension to its exclusive plan of liquidation-filing and vote solicitation periods, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive plan-filing period to April 13 from Jan. 13 and the solicitation period to June 10 from March 12. This is EBHI's second exclusivity extension request.

According to the motion, the company needs the extension to maintain progress toward confirmation of a consensual plan of liquidation, including negotiating with parties in interest and preparing information in anticipation of plan confirmation.

A hearing is scheduled for Jan. 28.

Eddie Bauer, a Bellevue, Wash.-based specialty retailer that sells outerwear, apparel and accessories, filed for bankruptcy on June 17, 2009. Its Chapter 11 case number is 09-12099.
