Kodak sued by Kyocera; patent infringement injunction, damages sought

By Caroline Salls

Pittsburgh, Jan. 4 - Kyocera Corp. filed a patent infringement lawsuit against Eastman Kodak Co. on Jan. 4 in the U.S. Bankruptcy Court for the Southern District of New York.

After Kodak filed for bankruptcy, Kyocera said Kodak "has been and is now manufacturing, using, importing, selling and/or offering for sale numerous products that infringe on U.S. patents owned by Kyocera."

Kyocera said Kodak is also contributing to and inducing others to infringe on the U.S. patents.

Through the complaint, Kyocera is seeking a permanent injunction against the alleged patent infringement. The plaintiff is also seeking damages in an unspecified amount.

The lawsuit alleges infringement on 15 separate Kyocera patents.

Kodak is a Rochester, N.Y.-based imaging technology products and services provider to the photographic and graphic communications markets. The company filed for bankruptcy on Jan. 19, 2012 in the U.S. Bankruptcy Court for the Southern District of New York under Chapter 11 case number 12-10202.
