DeCurtis: Court rejects Carnival’s attempt to continue litigation

Olympia, Wash., June 21 – The court overseeing DeCurtis Holdings LLC’s Chapter 11 bankruptcy case rejected Carnival Corp.’s motion for relief from the automatic stay to proceed in a pending civil action in Florida, according to an order filed with the U.S. Bankruptcy Court for the District of Delaware.

As background, DeCurtis has been litigating against Carnival, one of its prior clients, since April 2020.

Carnival said it was scheduled to file a motion for injunction in the Florida litigation to protect and recover its “sole property” on May 1, and alleges that DeCurtis “disrupted that schedule and sought to evade injunctive relief” by filing bankruptcy on April 30.

Carnival said the Florida district court, and in particular judge Robert N. Scola who presided over the litigation and trial, is in the best position to resolve issues efficiently and fairly regarding the parties’ respective rights.

Orlando, Fla.- based DeCurtis provides guest experience and operational management product-focused SaaS software solutions. The company filed bankruptcy on April 30 under Chapter 11 case number 23-10548.
