Independent Pet Partners asks court to extend exclusive periods

By Sarah Lizee

Olympia, Wash., June 5 – Independent Pet Partners Holdings, LLC is seeking a 90-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed with the U.S. Bankruptcy Court for the District of Delaware.

The company asked the court to extend the exclusive plan filing period through Sept. 5 and the exclusive solicitation period through Nov. 2.

The debtor has already filed a plan, but said it is seeking the extension out of an “abundance of caution.”

“The debtors have worked diligently over the past few months to preserve the value of their assets during the pendency of these Chapter 11 cases, and require the extension sought by this motion to ensure that they are able to seek confirmation of a Chapter 11 plan without any unnecessary distractions that would be caused by competing Chapter 11 plans,” the company said in its motion.

The combined plan and disclosure statement hearing is scheduled for June 29. The court will consider the exclusivity extension then as well.

The multichain pet care business has headquarters in Woodbury, Minn. The company filed bankruptcy on Feb. 5 under Chapter 11 case number 23-10153.
