Desert Home seeks 120-day extension of exclusive plan periods

Olympia, Wash., Jan. 9 – Borrego Community Health Foundation, which does business as Desert Home Care, is seeking an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed with the U.S. Bankruptcy Court for the Southern District of California.

The debtor asked the court to extend the exclusive plan filing period through May 3 and the exclusive solicitation period through July.

Desert Home said that while the combined plan is being solicited and the debtor anticipates confirmation shortly, it is seeking the extension out of an abundance of caution because the confirmation hearing occurs after the expiration of the exclusivity period.

The company said the official committee of unsecured creditors, as a proponent of the plan, has no objection to the extended deadlines.

The San Diego-based provider of in-home skilled nursing services filed Chapter 11 bankruptcy on Sept. 12, 2022 under case number 22-02384.
