Liberty Power asks court for fifth and final exclusivity extension

Olympia, Wash., Aug. 16 – Liberty Power Holdings LLC is seeking a fifth and final extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed with the U.S. Bankruptcy Court for the Southern District of Florida.

Specifically, the company asked the court to extend the plan filing period through Oct. 20 from Aug. 15 and the solicitation period through Dec. 20 from Oct. 12.

The company said in its motion that the debtors want to extend exclusivity so that parties with competing interests don’t hinder the debtors’ efforts to complete their investigation into potential causes of action and negotiate the terms of a potential plan of liquidation or reorganization.

In addition, extending the exclusive periods will permit the debtors to focus their attention on a final reconciliation of the final purchase price with buyer NRG Energy, Inc. after completion of the transition.

The debtors also need time to negotiate with Boston Energy Trading and Marketing LLC concerning the plan’s terms.

Liberty Power is an electric retailer based in Fort Lauderdale, Fla. The company filed Chapter 11 bankruptcy on April 20, 2021 under case number 21-13797.
