Kinetic Concepts loses patent lawsuit against BlueSky Medical

Tampa, Fla., Aug. 4 - A U.S. District Court jury has found that Wake Forest patents involved in the litigation between Kinetic Concepts, Inc. and BlueSky Medical Group, Inc were valid and enforceable, but the jury also said BlueSky's Versatile 1 product did not infringe the patents.

The Wake Forest patents relate to Kinetic Concepts' vacuum-assisted closure (VAC) system, used for the treatment of patients with serious, complex wounds.

Kinetic Concepts said it will challenge the finding of non-infringement before the trial court and on appeal, and there are likely to be significant post-verdict motions and hearings.

The court has not yet set a post-verdict schedule and will issue its final judgment in future proceedings.

"The jury verdict confirms our belief that the fundamental intellectual property covering our revolutionary VAC technology is valid and enforceable, although we plan to challenge the finding of non-infringement," Kinetic Concepts president and chief executive officer Dennert O. Ware stated in a news release.

Kinetic Concepts is a medical technology company based in San Antonio.
