Vascular Solutions says Diomed's patent infringement case will go to trial

Charlotte, N.C., Aug. 31 - Medical device company Vascular Solutions, Inc. said the U.S. District Court denied Diomed Holdings, Inc.'s motion for a summary judgment in its patent infringement claim.

"It has always been Vascular Solutions' position that the sale of Vari-Lase products does not infringe Diomed's single licensed method patent because they do not include the step of placing the laser fiber tip in continuous apposition to the vein wall, as required by the patent," chief executive officer Howard Root said in a company news release.

"Vascular Solutions' position was not adjudicated by the court in this decision, but instead will be the subject of a trial that we expect will be held sometime during 2007."

Minneapolis-based Vascular Solutions' Vari-Lase is an endovenous laser product line for the treatment of varicose veins.
