Aeromexico asks to extend exclusive plan filing period to Dec. 9

By Sarah Lizee

Olympia, Wash., Oct. 8 – Grupo Aeromexico, SAB de CV is seeking a fifth extension of its exclusive periods to file a Chapter 11 plan, according to a motion filed Thursday with the U.S. Bankruptcy Court for the Southern District of New York.

Specifically, the company asked the court to extend the plan filing period through Dec. 9 from Oct. 8. The solicitation period is currently set to expire on Dec. 8.

“While it has been a short time since the court’s entry of the fourth extension order, the debtors have continued to make substantial progress towards a successful reorganization,” the company said in its motion.

On Oct. 1, the debtors filed a Chapter 11 plan and related documents, including the disclosure statement.

The company said the debtors are working to resolve the outstanding issues in the plan and disclosure statement in advance of the hearing to approve the disclosure statement, currently scheduled for Oct. 21.

Aeromexico said it is also continuing to drive forward the various issues and negotiations in the case with an aim toward emerging from Chapter 11 by the end of this calendar year.

Grupo Aeromexico, a holding company for commercial aviation, is based in Mexico City. The company filed Chapter 11 on June 30, 2020 in the U.S. Bankruptcy Court for the Southern District of New York under case number 20-11563.
