Aearo Technologies gets another bridge order protecting exclusivity

Olympia, Wash., May 4 – 3M subsidiary Aearo Technologies secured another bridge order protecting its exclusive right to file and solicit votes on a Chapter 11 plan, according to an order filed Thursday with the U.S. Bankruptcy Court for the Southern District of Indiana.

The bridge order extends the exclusive plan filing period through June 26 and the exclusive solicitation period through Aug. 25.

As previously reported, the company has a pending motion that seeks a third extension of the exclusive plan filing period through July 31 and the exclusive solicitation period through Sept. 29.

A hearing on the pending motion is scheduled for May 10.

The court is also considering motions seeking dismissal of the company’s Chapter 11 case. However, the court has indicated that it does not intend to rule on those motions prior to May 10.

The U.S. trustee overseeing the case and two official committees of tort claimants have agreed to entry of the bridge order as part of a comprehensive agreement to avoid a contested hearing in advance of the court’s ruling on the motions to dismiss, Aearo said in its motion seeking the bridge order.

Aearo, the St. Paul-based 3M subsidiary, designs and manufactures materials for noise, vibration, shock, thermal and cushioning solutions for commercial vehicles, heavy equipment, medical equipment, electronics and aircraft. The company filed bankruptcy on July 26, 2022 under Chapter 11 case number 22-02890.
