DVI judge approves examination of Deloitte & Touche

By Jeff Pines

Washington, Oct. 6 - The judge in the DVI Inc. bankruptcy case authorized the company's committee of unsecured creditors to examine Deloitte & Touche LLP, DVI's pre-Chapter 11 auditor.

The order was filed with the U.S. Bankruptcy Court for the District of Delaware Wednesday.

The committee said it wants to interview a Deloitte & Touche professional who is knowledgeable about the auditor's relationship with the company from Jan. 1, 1997 to present. Deloitte & Touche resigned as DVI's auditor on June 2, 2003. In addition, it also wants documents related to DVI.

The documents the committee wants include audit documents, DVI's Securities and Exchange Commission filings, any solvency analysis, documents on DVI's accounting methods and how those methods may have led to Deloitte & Touche's resignation.

DVI, a medical equipment finance company, filed for bankruptcy on Aug. 25, 2003. Its Chapter 11 case number is 03-12656.
